Welcome to TakeTaxi, operated by ANEW CREATION LIMITED ("TakeTaxi", "we", "us", or "our"). These Terms & Conditions govern your use of the TakeTaxi website and mobile application (collectively, the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. About TakeTaxi

TakeTaxi is designed to help passengers find, translate, display, and communicate destinations in Hong Kong. The Service may also provide routing information, distance and journey estimates, taxi fare estimates, and other travel-related information.

TakeTaxi does not operate a taxi service, employ taxi drivers, dispatch taxis, or control the routes, fares, or services provided by taxi operators or drivers.

2. Addresses, Translations and Destination Information

TakeTaxi combines information from several sources to provide useful English and Chinese destination information.

While we work to keep our information accurate and up to date, addresses, place names, translations, locations, and other destination information may occasionally be incomplete, inaccurate, outdated, or unavailable.

Passengers should confirm their intended destination with the taxi driver where appropriate.

If you notice incorrect or confusing information, we encourage you to report it through our website so that we can investigate and improve the Service.

3. Routes, Journey Times and Fare Estimates

Any route, distance, journey time, or taxi fare displayed by TakeTaxi is an estimate only.

Actual journey times, routes, fares, tolls, surcharges, traffic conditions, and other charges may differ. The final taxi fare is determined by the taxi meter, applicable Hong Kong taxi regulations, and the route actually taken.

Unless otherwise stated, fare estimates are based on Hong Kong urban (red) taxis. New Territories (green) and Lantau (blue) taxis use different fare structures.

TakeTaxi does not guarantee that a particular route or fare estimate will match the route chosen by a driver or the final metered fare.

4. Free Service, Advertising and Premium Features

TakeTaxi offers core functionality free of charge and may display advertising.

We may also offer an optional Premium upgrade that removes advertising and provides additional features. The features, availability, and price of Premium may change from time to time.

Where a purchase is made through an app store or other third-party payment platform, payment processing, cancellations, refunds, and related billing matters may also be subject to that platform's applicable terms and policies.

5. Third-Party Data and Services

TakeTaxi uses or incorporates information and services from multiple sources. These may include:

• Hong Kong Government open data, including data made available through DATA.GOV.HK
• OpenStreetMap data for certain location information
• Google Maps Platform and related Google services for functions such as mapping, routing, distance calculations, and location display
• Information published by businesses, schools, institutions, venues, and other organizations
• A custom database maintained and improved by TakeTaxi

Different data sources may have different levels of coverage, accuracy, and availability.

Use of third-party data or services does not imply that the relevant provider sponsors, endorses, or is affiliated with TakeTaxi.

6. Data Provider Credits and Licences

Hong Kong Government Open Data

TakeTaxi uses certain public-sector data made available through DATA.GOV.HK.

Source: Government of the Hong Kong Special Administrative Region, DATA.GOV.HK, and the relevant organisations responsible for the applicable datasets.

Intellectual property rights in such data remain with the Government and/or the relevant organisations unless otherwise stated.

TakeTaxi uses Google Maps Platform and related Google services for certain mapping, routing, location, and journey-related functionality.

Google-provided content, branding, and services remain subject to Google's applicable terms, policies, and attribution requirements.

TakeTaxi does not claim ownership of third-party data, trademarks, branding, or other intellectual property belonging to these providers.

7. TakeTaxi Intellectual Property

Except for third-party content and data identified above or otherwise indicated, the TakeTaxi Service — including its design, software, branding, logos, original text, graphics, and internally created content — is owned by or licensed to ANEW CREATION LIMITED.

You may use the Service for personal and lawful purposes.

You must not, without permission:

• Copy or redistribute substantial portions of TakeTaxi's proprietary content
• Sell, sublicense, or commercially exploit TakeTaxi's proprietary content
• Attempt to interfere with or disrupt the Service
• Access the Service using automated methods in a way that places an unreasonable burden on our systems
• Reverse engineer or attempt to extract source code except where such restrictions are prohibited by law

Nothing in these Terms restricts rights you may have in third-party or openly licensed data under the applicable licence.

8. Third-Party Websites and Services

The Service may contain links to, display information from, or interact with third-party websites, platforms, APIs, or services.

We do not control those third parties and are not responsible for their availability, content, accuracy, privacy practices, or terms.

Your use of a third-party service may be subject to separate terms and policies provided by that third party.

9. Privacy, Analytics and Advertising

TakeTaxi may use analytics, advertising technologies, cookies, device information, or similar technologies to operate and improve the Service, understand usage, and support advertising.

Information about how we collect, use, and protect personal information is provided in our Privacy Policy.

10. Service Availability and Changes

We aim to keep TakeTaxi available and useful, but we do not guarantee uninterrupted or error-free access.

We may add, remove, modify, suspend, or discontinue features or parts of the Service where reasonably necessary, including in response to technical, commercial, legal, data-provider, or platform requirements.

We may also update destination information, translations, estimates, and other data without notice.

11. Disclaimer

TakeTaxi is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we do not make warranties or representations that:

• All addresses or translations are accurate or complete
• All destinations are correctly located
• Routes or journey times will be accurate
• Fare estimates will match the final taxi fare
• The Service will always be available, uninterrupted, or error-free
• Third-party information or services will remain available

TakeTaxi is provided as a convenience and should not be treated as professional transportation, navigation, legal, or other professional advice.

12. Limitation of Liability

To the maximum extent permitted by applicable law, ANEW CREATION LIMITED will not be liable for losses or damages arising from or connected with:

• Incorrect, incomplete, or outdated address information
• Translation errors or misunderstandings
• A taxi driver travelling to an unintended destination
• Routes chosen by taxi drivers or users
• Differences between estimated and actual fares
• Traffic, delays, tolls, surcharges, or journey times
• The availability or accuracy of third-party data or services
• Temporary interruption or unavailability of TakeTaxi

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under Hong Kong law.

13. Misuse of the Service

You agree not to use TakeTaxi unlawfully or in a way that could damage, disable, interfere with, or compromise the Service or other users.

You are responsible for your own use of the Service and for complying with applicable laws.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes to TakeTaxi, our data sources, third-party services, applicable laws, or our business practices.

When we make changes, we will update the "Last updated" date at the top of this page.

Your continued use of the Service after updated Terms take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.

Any disputes relating to these Terms or the Service are subject to the jurisdiction of the courts of Hong Kong, except where applicable law provides otherwise.
